Welcome to That One Time. These Terms of Service (“Terms”) are a legal agreement between you and Gosugi, based in California, USA (“ThatOneTime,” “we,” “us,” or “our”), and govern your use of our website (thatonetime.app), our app (app.thatonetime.app), and our iOS app (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
1. Who can use ThatOneTime
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
2. Your account
You sign in with your email through a magic link or one-time code, and you may optionally set a password. You are responsible for keeping your email inbox, any password, and any access links secure, and for all activity that happens under your account. Tell us promptly at [email protected] if you believe your account has been accessed without your permission.
3. The Service
ThatOneTime is a real-time, shared guide for trips and events. It lets a group plan together, keep everything in sync across devices, and collect photos and videos in a shared album. We’re continually improving the Service and may add, change, or remove features over time. Any curated content we provide (such as suggested places) is for convenience only — always verify details like hours, prices, addresses, and reservations directly with the provider.
4. Plans, payments & refunds
- One-time pricing. Trips and events are priced per trip or per event as a one-time purchase — not a recurring subscription. Only the trip organizer or event host pays; invited members and guests join free.
- Tiers. Each tier sets a capacity (such as the number of travelers or guests) and a per-person photo allowance for the shared album. Current pricing and limits are shown on our Trips and Events pages and at checkout. If you reach a limit, you can upgrade to a larger tier at any time; upgrades are charged at the then-current price.
- Photo unlocks. Each person has a photo allowance in a trip or event’s shared album. Anyone who reaches their allowance may optionally buy additional photo capacity — a one-time in-app purchase. These are separate, optional charges: a member or guest who buys more capacity for their own photos is charged directly, independent of what the trip organizer or event host paid.
- Payment processing. Payments are handled by Stripe (and, for purchases made through the iOS app, by Apple). By purchasing, you agree to the applicable processor’s terms. We don’t store your full card details.
- Taxes. Prices may not include taxes; where required, applicable taxes will be added.
- Refunds. Purchases are generally non-refundable except where required by law. If something goes wrong, contact us at [email protected] and we’ll try to make it right. Purchases made through the App Store are subject to Apple’s refund process.
5. Trip lifecycle & retention
Length limits. A trip can span at most 30 days and an event at most 7 days, counting the first and last day. For longer travel, create a separate trip for the next leg. Once an event has started, its start and end times can no longer be changed. A host who ends an event early can reopen it only while its scheduled end time hasn’t passed, and only a limited number of times. These limits apply on every plan, including paid tiers — upgrading adds capacity and photo allowance, not length.
Content is retained based on the tier of the trip or event, as described in our Privacy Policy. On the free tier, a trip becomes read-only a period of time after it ends; upgrading keeps it editable and stored longer. ThatOneTime is not a backup service — you are responsible for keeping your own copies of important photos and information, which you can download from the Service at any time.
6. Your content
You keep ownership of the content you add to the Service — your plans, notes, photos, and videos (“Your Content”). By adding Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, adapt (for example, to resize images or transcode video), display, and share it as needed to operate the Service for you and the group you share it with. This license exists only to run the Service and ends when you delete the content or your account, except for content others have saved and reasonable residual copies in backups.
You represent that you have the rights necessary to share Your Content and that it does not violate the law or the rights of others — including the rights of anyone who appears in the photos and videos you upload.
7. Acceptable use
When using the Service, you agree not to:
- Upload or share content that is unlawful, infringing, harassing, hateful, or that violates someone’s privacy or intellectual-property rights;
- Upload content sexually exploiting or endangering minors, or any other illegal content;
- Access trips, events, or accounts that aren’t yours, or attempt to defeat access controls or share links you weren’t given;
- Interfere with, overload, or disrupt the Service, or probe it for vulnerabilities without our permission;
- Reverse engineer, scrape, or use the Service to build a competing product; or
- Use the Service to send spam or to impersonate others.
We may remove content or suspend accounts that violate these Terms.
8. Sharing & access links
The Service lets you invite members and create read-only guest or recap links. You are responsible for who you invite and who you share links with. Anyone with an active link can view the content it points to until you revoke it. Revoking a link or removing a member stops future access but may not undo copies already downloaded.
9. Our intellectual property
The Service itself — including the ThatOneTime name, logo, design, software, and curated content — is owned by us or our licensors and is protected by intellectual-property laws. These Terms don’t grant you any right to use our brand or materials except as needed to use the Service normally.
10. Third-party services
The Service integrates with third parties (for example, map links, payment processing, email delivery, and media hosting) and may link to third-party sites. We don’t control those services and aren’t responsible for their content or practices. Your use of them is governed by their own terms.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information in it (including suggested places, addresses, or travel details) is accurate or complete. You use the Service, and travel, at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, ThatOneTime and Gosugi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the trip or event giving rise to the claim in the twelve months before the claim, or US $50. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless ThatOneTime and Gosugi from any claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.
14. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably need to for security, legal, or operational reasons. Sections that by their nature should survive termination — such as content licenses already granted to others, disclaimers, limitations of liability, and indemnification — will survive.
15. Changes to the Service & Terms
We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms. If you don’t agree, please stop using the Service.
16. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute that isn’t otherwise resolved, and you consent to venue there, to the extent permitted by law.
